Overview:
Herbert Smith's Hong Kong office was established in 1982 and is the headquarters of the firm in Asia. The office now has 17 partners and over 70 fee-earners who are qualified to practise in several different jurisdictions, including Hong Kong, the PRC, the US, England and Australia. This makes Herbert Smith one of the largest international law firms in Hong Kong.
The office acts as the firm's regional headquarters and co-ordinates and handles work throughout Asia. It is a full service practice advising on regulatory, dispute resolution, corporate, energy and projects, TMT and banking & finance matters.
The Hong Kong dispute resolution practice works closely with the mainland China team and is fully integrated with the Herbert Smith disputes practices in Asia, the Middle East and Europe. They provide clients with global support on the complex cross-border disputes that are becoming increasingly prevalent as China becomes one of the largest trading partners in the global market.
The regulatory practice is ranked in the first tier and is one of the largest in Hong Kong. We maintain strong relationships with financial intermediaries, including global investment banks. The team also has a sophisticated understanding and appreciation of the regulatory issues facing this sector.
The corporate team advises clients on mergers and acquisitions, private equity investments, privatisations, regulatory compliance, capital markets transactions and takeovers. This market standing is demonstrated by our appointment as adviser to the 'G-12 Group' of leading investment banks in Hong Kong. The US securities team in Asia is also based in Hong Kong which provides support on US securities laws and liability issues.
The Asia projects and energy team is based in Hong Kong and works closely with teams in Singapore, Tokyo, Beijing, Shanghai and Jakarta. This Asia-wide coverage is a key factor that distinguishes Herbert Smith from the competition. This group includes lawyers who have worked in-house with energy majors and regional players.
The banking group advises on all debt finance activities, including commercial bank lending, debt capital markets, structured financings, asset-based finance and off-balance sheet financing techniques. Together with the firm’s corporate recovery group, the banking group boasts a leading restructuring, work-out and insolvency practice. They have worked on standstill arrangements, rescheduling and restructuring of debt, creditors’ schemes of arrangement, appointment of receivers, enforcing security and liquidations.
Our market leading TMT team advises on the full range of legal issues in relation to technology, media, telecommunications and intellectual property. In particular, our capability in the telecommunications sector is unparalleled – we are highly recognised in all regulatory, transactional and dispute resolution aspects.
Our competition practice regularly advises clients in one of the two sectors where Hong Kong has a significant competition law - telecommunications. This includes competition issues affecting mergers and acquisitions and specialist advice on high level competition policy and market restructuring.
